Os Desafios e Perspectivas Normativos Advindos do Estabelecimento do Tribunal Penal Internacional para as Relações Internacionais Contemporâneas

Resumo

Opresente artigo pretende dar início a uma investigação dos temas éticos envolvidos no estabelecimento de um Tribunal Penal Internacional (TPI) de caráter permanente, isto é, os desafios e perspectivas normativos advindos da implementação desse organismo internacional de caráter jurídico com implicações consideráveis para a estrutura e dinâmica do sistema internacional. No que tange aos desafios, será feita uma investigação no sentido de verificar em que medida a idéia de constituir uma organização internacional que consagre o indivíduo como a unidade de valor moral supremo e institua uma justiça internacional de caráter político permanente instala um questionamento acerca de duas constantes das Relações Internacionais, conforme a perspectiva racionalista: o Estado-Nação e a Ordem Internacional Anárquica. Quanto às perspectivas, será feita uma análise que busque identificar em que medida é possível atrelar a solidificação de uma Corte Penal Internacional à concretização de um projeto cosmopolita, em que os indivíduos situados em uma posição original global deliberariam sobre os princípios de justiça a serem aplicados às instituições que compõem a estrutura básica global.

ABSTRACT

This paper intends to initiate a research of the ethical themes involved in the establishment of a permanent International Criminal Court, in other words, the normative challenges and perspectives which emerge with the implementation of an international organization that brings various implications to the dynamic and structure of the international system. Regarding the challenges, there will be an investigation towards verifying to what extent the idea of building an international organization centered on the human-being as the ultimate unit of moral concern and worried about parameters for a permanent political international justice puts into question two constants of International Relations according to the rationalist perspective: the Sate-Nation and the International Anarchical Order. Concerning the perspectives, it will be analyzed to what extent it is possible to connect the solidification of an International Criminal Court with the realization of a cosmopolitan project, bearing especially in mind the Kantian project of perpetual peace, in which human beings situated in a global original position would deliberate about principles of justice to be followed by the institutions that are encompassed by the global basic structure.
